1. Agreement to Terms

By accessing or using the MapKmlTools web application (the "Service") operated by ILoveGIS ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

2. Description of Service

MapKmlTools provides a suite of browser-based Geographic Information System (GIS) tools. These tools allow users to view, edit, convert, and analyze spatial data formats such as KML, KMZ, GeoJSON, Shapefiles, and CSVs.

Client-Side Processing: Unlike traditional web applications, MapKmlTools performs the vast majority of data processing locally within your web browser. This means your spatial files are not uploaded to our servers for processing.

3. Acceptable Use Policy

You agree not to use the Service to:

• Process, distribute, or share data that you do not have the legal right to use or distribute.
• Use the Service for any illegal, unauthorized, or unethical purpose, including but not limited to violating intellectual property rights or privacy laws.
• Attempt to reverse engineer, decompile, or extract the source code of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated scripts, bots, or scrapers to interact with the Service without our explicit written permission.

4. Intellectual Property & User Data

Our Intellectual Property

The Service and its original content, features, functionality, user interface, and software code are and will remain the exclusive property of MapKmlTools and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Your Data

You retain all of your ownership rights in your data. By processing files through our client-side tools, you do not grant us any licenses or rights to your data. Because processing happens in your browser, we do not store, host, or have access to the contents of the files you parse using the local tools.

If you choose to use our cloud-save features (e.g., Map Creator cloud storage), you grant us a temporary, limited license to host that specific data solely for the purpose of providing the save/share functionality to you.

5. Account Registration and Security

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

6. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Accuracy Warning: While we strive for precision in our algorithms (such as area calculation, distance measurement, and coordinate projection), we do not guarantee absolute accuracy. MapKmlTools is designed for preliminary analysis, educational purposes, and visualization. It must not be used as a substitute for professional legal land surveys, certified engineering assessments, or life-critical navigation systems. Always verify critical data with certified professionals.

7. Limitation of Liability

In no event shall MapKmlTools, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any inaccuracies or errors in spatial calculations, format conversions, or map renderings;
• Unauthorized access, use or alteration of your transmissions or content.

8. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by MapKmlTools. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that MapKmlTools shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account from the user dashboard.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the creators of MapKmlTools operate, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
